Welcome to Promote. By accessing or using the Promote mobile application ("App"), you agree to these Terms of Service.
If you do not agree to these Terms, do not use the App.
1. Use of the App
Promote provides a platform for users to discover, browse, and engage with events and services. You agree to use the App only for lawful purposes and in accordance with these Terms.
You must not:
- Use the App for any unlawful, misleading, fraudulent, or harmful purpose
- Attempt to gain unauthorized access to any part of the App, its systems, or related accounts
- Interfere with or disrupt the operation, security, or performance of the App
- Use the App in a way that could damage, disable, overburden, or impair our services
- Upload or distribute malicious code, spam, or abusive content
2. Eligibility
You must be at least 13 years old to use Promote. By using the App, you represent that you meet this requirement and that you are legally able to accept these Terms.
3. User Accounts
Some features require an account.
- Provide accurate and current information
- Keep your login credentials secure
- Be responsible for activity that occurs under your account
We may suspend, restrict, or terminate accounts that violate these Terms or create risk to the platform or other users.
4. User Content
Promote may allow users to create, upload, publish, or share content, including:
- Event listings
- Service listings
- Profile information
- Photos or other media
- Messages, interactions, or related activity
You are solely responsible for the content you submit and for the consequences of posting it.
You agree not to post content that:
- Is false, misleading, or deceptive
- Violates any law or regulation
- Infringes on another person's rights
- Is abusive, threatening, defamatory, obscene, or otherwise harmful
- Contains malware, spam, or unauthorized promotional material
Promote reserves the right, but not the obligation, to review, remove, restrict, or refuse content at our discretion.
5. Events and Services Disclaimer
Promote is a platform only.
Promote does not organize, host, manage, control, endorse, or guarantee third-party events or services listed in the App.
Event organizers, service providers, and other users are solely responsible for:
- Their listings
- Their conduct
- The accuracy of information they provide
- Delivering any event or service they advertise
You acknowledge and agree:
- You attend events at your own risk
- You engage providers and services at your own discretion
- Promote is not responsible for cancellations, delays, injuries, losses, disputes, damages, or misrepresentations related to third-party events or services
6. Social Features
Promote may provide social features such as following users, viewing limited activity based on privacy settings, and attendance visibility controls.
These features are provided for convenience only. You are responsible for your interactions with other users.
7. Location Features
Promote may use location information to show nearby events and services.
Location-related features may depend on your settings. If enabled, the App may use precise location. If disabled, the App may rely on a city-based fallback or other user-selected location behavior.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
9. Intellectual Property
Promote and its related branding, design, software, text, graphics, and other content provided by us are owned by or licensed to Promote and are protected by applicable laws.
10. Termination
We may suspend, limit, or terminate your access to the App at any time, with or without notice, if:
- You violate these Terms
- We believe your use creates risk, harm, or legal exposure
- We are required to do so by law
- We discontinue part or all of the App
11. Disclaimers
The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
12. Limitation of Liability
To the fullest extent permitted by law, Promote and its owners, operators, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of or inability to use the App, third-party events or services, user conduct, unauthorized access to data, or outages.
13. Indemnification
You agree to defend, indemnify, and hold harmless Promote and its owners, operators, affiliates, and service providers from and against claims, liabilities, damages, losses, and expenses arising from your use of the App, your content, your violation of these Terms, or your violation of any rights of another person or entity.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we may revise the Effective Date above. Your continued use of the App after changes become effective means you accept the revised Terms.
15. Governing Law
These Terms will be governed by and interpreted under the laws of Mississippi, without regard to conflict of law principles.
